1. The Contest

The Contest. The Frog World  Championship 2019 Contest ("Contest") is an online contest  organised through joint collaboration between  FrogAsia Sdn Bhd (Company No. 968641-K) ("FrogAsia") and Frog Education Ltd (“Frog”) (Company No. 03935677) and is  participated by Participants from Malaysia, Australia, Hong Kong, United Kingdom, Denmark, France, Switzerland, Italy, Luxembourg, Netherlands,  Spain, the United States, Saudi Arabia, United Arab Emirates and South Africa (collectively referred to as the “Participating Countries”) on their respective e-learning platforms and in accordance to the respective countries time zone. Participants in each of the respective countries shall be subjected to the contest terms and conditions stated on their respective e-learning platforms.  In Malaysia, those eligible students and schools may participate in the Contest through the FrogPlay Platform and shall be governed by these Frog World Championship 2019 Contest Terms and Conditions (hereinafter referred to as the “Contest Terms”).

 

2. Eligibility

2.1 The Contest is organised on FrogAsia’s Frog Virtual Learning Environment or more commonly known as “Frog VLE” (“FrogPlay Platform”).

2.2  This Contest is open to:

     2.2.1 the national schools (“Participating Schools”);  and

     2.2.2 individual students from national schools (“Participating Students”)

  in Malaysia with 4G connectivity and having access to the FrogPlay Platform.


For the purposes of this Contest Terms, Participating Schools and Participating Students may collectively be referred to as “Participants”.

 

3. Contest Terms Acceptance

The Participants may access the Contest page either through FrogPlay Platform or www.frogchampionships.com. Each Participant is required to click the quick launch tab for first time access to the Contest page and a welcome note will pop-up incorporating a link to the Contest Terms. Subject to a Participating Student who is a minor, each Participant confirms having read and understood, and agrees to be bound by these Contest Terms through the Participant’s participation in the Contest. In the case of a Participant who is a minor, it is the responsibility of such minor Participants’ parents or legal guardian to continuously supervise his/her participation in the Contest.

For clarity and avoidance of doubt, each Participating School shall be entitled to single entry participation only. In the event of multiple submissions by any of the Participating Schools, all such submissions shall be consolidated as single entry participation.

 

4. Contest Period

4.1 This Contest shall commence on 11th February, 2019, 12 am (“Commencement Date”) and shall run for a period as more particularly stated herein:

4.1.1 Contest period for Participating Schools is divided into two (2) phases as follows:

(a) Contest 1st phase commencing on the Commencement Date through 15th March 2019, 11.59pm (“Contest 1st Phase”); and

(b) Contest 2nd phase commencing on 1st April 2019, 12am through 26th April 2019, 11.59pm (“Contest 2nd Phase”).

4.1.2 Contest period for Participating Students shall commence on the Commencement Date through 15th March 2019, 11.59pm.

 

5. Contest Entry Procedure

All Participants shall be automatically registered to the Contest. The Participants may opt out of the Contest by completing the relevant fields in the opt-out form available at www.frogchampionships.com/opt-out within the Contest page. For further information on the opt-out process, please refer to the FAQ @ https://www.frogchampionships.com/faq-eng.

 

6. Contest Mechanism

6.1  The Contest Mechanism is as follows:

6.1.1 Participating Students

6.1.1.1 Each Participating Student is required to log into the FrogPlay Platform and answer as many quizzes as possible on any of the subjects available on the FrogPlay Platform. For the purpose of this Contest, score will be granted to the Participating Students having answered the quizzes on the FrogPlay Platform between 7am until 10pm during the Contest Period.

6.1.1.2 The score granted to the Participating Students is based on the algorithm within the FrogPlay Platform in accordance to the following broad criteria:

(a) Days utilised on FrogPlay Platform: Number of days spent by the Participating Students on the FrogPlay Platform to complete the quizzes.

(b) Number of quizzes: Number of different quizzes completed by students in the Participating School.

6.1.1.3 The score obtained by the respective Participating Students will be reflected on the students’ leaderboard within the FrogPlay Platform (“Student Leaderboard”) on a delayed time basis and will be refreshed every day during the Contest Period by 9am.

6.1.1.4 The selection of Winners-Student Category is based on the total score obtained by each Participating Student during the Contest Period.

6.1.1.5 In the event any of the Participating Student is transferred or shifts to a new school (“New School”), any scores obtained by such Participating Student through his/her participation in the Contest prior to the official joining date in the New School shall be automatically forfeited. Notwithstanding hereinbefore, the former Participating  School shall be entitled to retain the collective scores obtained by it through the participation of such Participant Students up to the date of his/her official joining date in the New School. Such Participating Student may participate in the Contest as a participant of the New School on condition that the New School is equipped with 4G connectivity and have access to Frog VLE Platform. If the New School is an Appliance School, such Participating Student will be entitled to participate in the Contest as a participant of the New School and be subjected to the Frog World Championships 2019 Terms and Conditions (Appliance School) found at https://www.frogchampionships.com/terms-conditions-appliance.

6.1.1.6 In the event of a tie between the National Level Winners-Student Category, the selection of tie-breaker winner will be required to respond to a tie-breaker question posed by FrogAsia. The Participating School with the most creative answer as determined by FrogAsia at its sole and absolute discretion will be declared as the winner.

6.1.1.7 A detailed description of winners selection process is as more particularly stated in Clause 7 of these Contest Terms.

6.1.2      Participating Schools

6.1.2.1 Contest 1st Phase

During the Contest 1st Phase, Participating Schools are required to log into the FrogPlay  Platform and to use and/or publish quizzes by creating availability and provide exposure on quizzes to the Participating Students as part of teaching and learning experience. At the end of Contest 1st Phase, three (3) schools respectively with the highest scores as reflected on the School Leaderboard will be declared  as winners at national level (“National Level Winners -School Category”).

Simultaneous to the selection of the National Level Winners – School Category, ten (10) Participating Schools, with the highest scores as reflected on the School Leaderboard, will be shortlisted to participate in the Contest 2nd Phase (“International Representatives-School Category”).

The score granted to the Participating Schools is determined by an algorithm within the FrogPlay Platform based on the following broad criteria:

(a) Student logins: Total number of students having logged in to the FrogPlay Platform in the respective Participating School.

(b) Number of quizzes: Number of different quizzes completed by students in the Participating School.

(c) Teachers Logins: Number of teachers from the respective Participating Schools having logged in to the FrogPlay Platform.

(c) Quizzes Created: Number of original quizzes created by teachers in Participating Schools and published to school.

The score obtained by the Participating School during the Contest Period  will be reflected on the school’s leaderboard found on the FrogPlay Platform (“School Leaderboard”) on a delayed time basis and will be refreshed every day during the Contest Period by 9am.

The selection of National Level Winners–School Category will be based on the total score reflected on the School Leaderboard during the Contest Period.

A detailed description of the National Level Winners-School Category selection process is as more particularly stated in Clause 7 of these Contest Terms.

In the event of a tie in score between the National Level Winners-Schools Category, such Participating Schools are required to respond to a tie-breaker question posed by FrogAsia. The Participating School with the most creative answer as determined by FrogAsia at its sole and absolute discretion will be declared as the winner.

6.1.2.3 Contest 2nd Phase

The International Representatives-School Category are required to to prepare and submit a critical analysis on their learning experience, with examples, on their use of FrogPlay Platform between 1st April 2019, 12am through 15th April 2019, 11.59pm.  The critical analysis shall be prepared by using a Google Form (or such other method as notified by FrogAsia to the International Representatives-School Category, and shall include the contents listed below:

(a) The impact of FrogPlay Platform  on students’ performance, including any changes  of behaviour or habit from an academic perspective;

(b) The roles and responsibilities undertaken by the headmaster and teachers to continuously encourage students and creative methods adopted in ensuring a school-wide use of FrogPlay Platform; and

(c) The impact of FrogPlay Platform within the scope of teaching and learning.

(Clauses (a)-(c) hereinbefore shall be collectively referred to as the “Critical Analysis”).

Score granted to the respective International Representative-School Category is determined based on the qualitative and quantitative aspects incorporated into the Critical Analysis, details of which are as more particularly stated below:

Quantitative Aspects

(a) Student logins: Total number of students having logged in to the FrogPlay Platform in the respective Participating School.

(b) Number of quizzes: Number of different quizzes completed by students in the Participating School.

(c) Teachers Logins: Number of teachers from the respective Participating Schools having logged in to the FrogPlay Platform.

(d) Quizzes Created: Number of original quizzes created by teachers in Participating Schools and published to school.

Qualitative Aspects

(a) Teaching & Learning Impact : Showcase positive learning impact in student mindset, interest and academic progress. School also able to demonstrate positive impact on teaching that has been made made easier and focused.

(b) School Management & Administration Impact: The ability for the school to enable more effective, efficient outcomes in cost saving management and administration in school.

(c) Evidences School Collaboration: Demonstrates the ability to collaborate between different individuals to meet school goals and the ability to overcome the challenges within a 21st century teaching and learning environment.

Upon submission of the Critical Analysis, the International Representatives-School Category are required to attend a Question and Answer Session on the impact of FrogPlay Platform within the scope of their teaching and learning experience before a panel of judges appointed by FrogAsia on a pre-arranged date/(s) as decided by FrogAsia, which shall be between 16th April, 2019 until 26th April, 2019) (“Q&A Session”), and scores will be granted by the judges based on critical analysis and response provided by each of the International Representatives-School Category during the Q&A Session.

 

7. Winners Selection Process

7.1 Participating School Category

7.1.1 National Level Winners -School Category

At the end of the Contest 1st Phase, three (3) Participating Schools with the highest score reflected on the School Leaderboard will be declared as the national level  winners (“National Level Winners- School Category”).

7.1.2 International  Winners-School Category

At the end of the Contest 2nd Phase, three (3) schools from a combination of Participating Countries having  obtained the highest score during the Q&A Session will be declared as the international level winners (“International Winners-School Category”).

7.2 Participating Student  Category

7.2.1 National Level Winners-Students Category

Three (3) students respectively with the highest scores reflected on the Student Leaderboard will be declared as  the national level winners (“National Level  Winners- Students Category”).

7.2.2International Winners-Students Category

Simultaneously, at the international level, three (3) students from a combination of all the Participating Countries, with the highest scores reflected on the Student Leaderboard will be declared  as international level winners (“International Winners-Students Category”).

 

8. Contest Prizes

8.1 The winners, in order of rank from the most to the least critical shall be categorised as:-

8.1.1  Grand Prize Winner;

8.1.2  1st Runner Up; and

8.1.3  2nd Runner Up

and shall be entitled to the Contest Prizes

Clauses 8.1.1, 8.1.2 and 8.1.3 shall be collectively referred to as the “Winners”).

8.2   The Winners will be entitled to the following prizes:-

8.2.1 National Level Winners –School Category:

(a) The  Grand Prize Winner will receive cash sum of Ringgit Malaysia Three Thousand (RM 3,000) only, Pelangi book voucher worth Ringgit Malaysia Three Thousand (RM 3,000) only, a trophy and a certificate;

(b) The 1st Runner Up will receive cash sum of Ringgit Malaysia Two  Thousand (RM 2,000) only, Pelangi book voucher worth Ringgit Malaysia Two Thousand (RM 2,000) only, a trophy and a certificate; and

(c) The 2nd Runner Up will receive cash sum of Ringgit Malaysia One  Thousand (RM 1,000) only, Pelangi book voucher worth Ringgit Malaysia One Thousand (RM 1,000) only, a trophy and a certificate.

 

8.2.2 International Level Winners -School Category

In the event any of the  International Representative-School Category from Malaysia is declared as  either the Grand Prize Winner, 1st Runner Up or 2nd Runner Up of the International Level Winners -School Category, such International Level Winners - School Category will receive the following prize:

a) The Grand Prize Winner will receive cash sum of US Dollars Three Thousand (USD 3,000) only, a trophy and a certificate;

(b) The 1st Runner Up will receive cash sum of US Dollars Two  Thousand (USD 2,000) only, , a trophy and a certificate; and

(c) The 2nd Runner Up will receive cash sum of US Dollars One  Thousand (RM 1,000) only, a trophy and a certificate.

 

8.2.3 National Level Winners  –Student Category

  1. Grand Prize Winner

    1. Subject to Clause 8.3 below, Yes 4G Altitude together with pre-loaded prepaid plan for the sum of Ringgit Malaysia Three Hundred (RM 300.00) only (“Yes 4G Package”);

    2. Pelangi book voucher worth Ringgit Malaysia Five Hundred (RM 500) only;

    3. Merchandise pack consisting of stationeries and back pack worth Ringgit Malaysia Twenty (RM 20) only;

    4. Medal; and

    5. Certificate

 

  1. 1st Runner Up

    1. Subject to Clause 8.3 below, Yes 4G Altitude together with pre-loaded prepaid plan for the sum of Ringgit Malaysia Three Hundred (RM 300.00) only (“Yes 4G Package”);

    2. Pelangi book voucher worth Ringgit Malaysia Three Hundred (RM 300) only;

    3. Merchandise pack consisting of notebook worth Ringgit Malaysia Fifteen (RM 15) only;

    4. Medal; and

    5. Certificate

 

  1. 2nd Runner Up

    1. Subject to Clause 8.3 below, Yes 4G Altitude together with pre-loaded prepaid plan for the sum of Ringgit Malaysia Three Hundred (RM 300.00) only (“Yes 4G Package”);

    2. Pelangi book voucher worth Ringgit Malaysia Two Hundred (RM 200) only;

    3. Merchandise pack consisting of stationaries worth Ringgit Malaysia Ten (RM 10) only;

    4. Medal; and

    5. Certificate

 

8.2.4 International Level Winners - Students Category

In the event any of the National Level Winners - Students Category is declared as the International Level Winners -Students Category, such International Level Winners -Student Category will receive the following prize:

(i) Trophy; and

(ii)Certificate

8.3 The Yes 4G Package shall be subjected to the terms and conditions imposed by the sponsor including the applicable terms and conditions found at https://www.yes.my/tnc/products-services-tnc. All National Level Winners -Students Category who are minors shall obtain the consent of and must be accompanied by parents or legal guardians during collection of the Yes 4G Package.

 

8.4 The Winners  shall not be entitled to redeem the Prizes in any other form or manner other than that specified by FrogAsia.

8.5 All Prizes are accepted entirely at the risk of the Winners. Prizes are awarded by FrogAsia and/or sponsors without any warranty of any kind express or implied.

 

9. Announcement of Winners

The respective announcement will be done through  championships@frogasia.com and FrogAsia’s Facebook page and/or such other mode or manner as decided by FrogAsia at its sole and absolute discretion by 9th May 2019.

 

10. Exclusions

The Contest Prizes are given and accepted entirely at the risk of the winners. Any and all prize-related expenses, including tax liabilities (if any) in relation to this Contest, prize and/or use or enjoyment of the same, shall be the sole responsibility of the winners. FrogAsia shall not be held liable for (i) any delay in performing or partial/total failure to perform any of its obligations to the winners under this Contest if such delay or failure is caused by circumstances beyond the reasonable control of FrogAsia, its affiliates, authorized dealers/distributors, agents or suppliers, including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes or (ii) from any loss, damage to property, injury, or death resulting from or related to the Participants’ participation or inability to participate in this Contest, or the use, misuse or inability to use the Content Prizes or any portion thereof.

 

11. Unconditional Agreement

Acceptance of the Contest Prizes constitutes the winners unconditional agreement and permission to FrogAsia and its agencies to use  the winners’ names, video footages, voices, photographs and/or likeness for purposes of advertising, editorial, promotional, marketing, trade and/or other purposes without further compensation and notice, unless prohibited by law. FrogAsia reserves the right to such forms of publicity and publication.

 

12. Laws

This Contest shall in all respect be governed by the laws of Malaysia.  By entering this Contest, the Participants agree to submit to the jurisdiction of the courts of Malaysia.

 

13. Modifications

FrogAsia reserves the right to add, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Contest, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Participants or any other party. Without prejudice to the aforesaid, FrogAsia reserves the right to cancel, terminate or suspend this Contest at any time before or during the Contest Period with due notice but without any liability or compensation whatsoever. In the event of such cancellation, termination or suspension of this Contest, FrogAsia may at its sole and absolute discretion choose not to award the Contest Prizes in respect of this Contest or choose not to select any winner.

 

14. Disruption of Contest

Without prejudice to Clause 13 above, if for any reason this Contest is not capable of running as planned or is disrupted for reasons due to and including without limitation network failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of FrogAsia or any party responsible for the running of any aspect of this Contest which corrupts or affects the administration or proper conduct of this Contest, FrogAsia reserves all rights in Clause 13 above and further reserves the right at its sole and absolute discretion to disqualify any individual or party who tampers or cheat with the processes of this Contest and/or its mechanics and FrogAsia may take any action (including legal action) against such individual or party. FrogAsia shall not accept any responsibility for entries not received for whatever reason. FrogAsia shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to this Contest.

 

15. Disclosure Rights

By entering this Contest, the Participants hereby grant to FrogAsia express permission as well as a non-exclusive, royalty-free, worldwide license to publish, print, reproduce, disseminate or share their respective entry, likeness and identity (excluding any sensitive personal information as defined in the Personal Data Protection Act 2010) for editorial, advertising, promotional, marketing or other purposes, without further compensation, for an unlimited period of time, in any of FrogAsia's publications, in any form or any media, whether for public consumption or otherwise, unless prohibited by law.

 

16. Disqualification and/or Rejection of Entries

FrogAsia reserves the right to disqualify any or all  the Participants or winners at its sole and absolute discretion on grounds of non-compliance with any of the Contest Terms. For the avoidance of doubt, the foregoing is not meant to limit or curtail the rights of FrogAsia, who may also reject an entry without having to assign any reasons whatsoever. The Participants accept that a decision to disqualify and/or reject such  winners shall be final and conclusive without any right to appeal. In the event of disqualification after the Contest Prizes, FrogAsia reserves the right to demand for the return of the Contest Prize or payment of its value from such ineligible or disqualified winners.

 

17. Judging Criteria and Judging Process

FrogAsia reserves the sole and absolute discretion to determine winners of this Contest. The judges' decision shall be final and conclusive and no appeals or disputes will be entertained. Subject to FrogAsia's rights to replace any of the winners as provided herein, results once announced shall be deemed as final and binding.

 

18. General Indemnification

Participants shall indemnify FrogAsia against all and any demands, claims, costs, expenses, damages, liability or injury (whether physical in nature or against the reputation of any party) incurred by FrogAsia, arising out of or relating to the Participants’ participation in this Contest and/or Participants’   acceptance, use or misuse of prizes, including but not limited to any of the Participants’ acts, omissions, statements, publications whatsoever as may be in breach of any law or legal rights, as the case may be.

 

19. Third Party's Rights and Indemnification

By participating in this Contest, the Participants warrant that all personal details, answers, responses and/or entries submitted in this Contest are true and accurate. Participants agree to indemnify and keep indemnified FrogAsia against all claims, losses, damages and/or expenses whatsoever arising from any infringement or violation of any third party's rights in relation to the participation in this Contest.

 

20. Survivability of Terms

Any delay, waiver, non-enforcement, modification, amendment, withdrawal or substitution of any term or condition contained herein shall not affect the operation of the other terms or conditions so affected by such a waiver, non-enforcement, modification, amendment, withdrawal or substitution and which shall remain in full force and effect.

 

21. Personal Data

By participating in the Contest, each Participant agrees and consents to the processing of Personal Data provided to FrogAsia and/or its service providers shall be used for the purpose of the Contest and as set forth in this Contest Terms. For the avoidance of doubt, the word “Personal Data” and “processing” as used in this Clause 21 shall have the same meaning ascribed to in the Personal Data Protection Act 2010.

 

22. Non-Compliance

Failure to comply with these Contest Terms shall result in disqualification of the relevant Participants.
