Frog Championships Boost Your Play (Frog Cloud League) Contest Terms and Conditions

 

1. The Contest

The Frog Championships Boost Your Play (4G League) Contest ("Contest") is an online contest organised by FrogAsia Sdn Bhd (Company No. 968641-K)("FrogAsia"). All eligible students, teachers and schools may participate in the Contest through the Frog VLE Platform (as defined below) and shall be governed by these Frog Championships Boost Your Play (4G League) Contest Terms and Conditions (hereinafter referred to as the “Contest Terms”). The Contest objective is aimed to test the knowledge of Participating Students in various subjects including Mathematics, English and Science. Simultaneously, the Contest is also aimed to encourage the Participants to use the Frog VLE Platform as part of their teaching and learning experience.

There shall be no fees or charges imposed to enter or win the Contest.

 

2. Eligibility

2.1 The Contest is organised on FrogAsia’s Frog Virtual Learning Environment or more commonly known as “Frog VLE” (“Frog VLE Platform”).

2.2 This Contest is open to:

2.1.1 the national schools in Malaysia (“Participating Schools”); and

2.2.2 individual students from national schools (“Participating Students”)

with 4G connectivity and having access to the Frog VLE Platform

For the purposes of these Contest Terms, Participating Schools and Participating Students may collectively be referred to as “Participants”.

 

3. Contest Terms Acceptance

The Participants may access the Contest page either through Frog VLE Platform or www.frogchampionships.com. Each Participant is required to click the quick launch tab for first time access to the Contest page and a welcome note will pop-up incorporating a link to the Contest Terms. Subject to a Participating Student who is a minor, each Participant confirms having read and understood, and agrees to be bound by, these Contest Terms through the Participant’s participation in the Contest. In the case of a Participant who is a minor, it is the responsibility of such minor Participants’ parents or legal guardian to continuously supervise his/her participation in the Contest.

For clarity and avoidance of doubt, each Participating School shall be entitled to a single entry participation only. As such, in the event of multiple submissions by any of the Participating Schools, all such submissions shall be consolidated as a single entry participation.

 

4. Contest Period

4.1 This Contest shall commence on 1st April, 2019, 12 am (“Commencement Date”) and end on 30th August, 2019, 11.59pm (“Contest Period”) and is divided into three (3) main phases namely:

4.1.1 Frog VLE Platform Usage Phase;

4.1.2 Critical Analysis Phase; and

4.1.3 Question & Answer Phase.

For clarity and avoidance of doubt, only Participating Schools may participate in the Critical Analysis Phase and the Question & Answer Phase subject to the conditions as more particularly stated in the Contest Mechanism in Clause 6 herein.

4.2 The Frog VLE Platform Usage Phase will commence on the Commencement Date and end on 26th July, 2019, 11.59pm (“Frog VLE Usage Period”) and is divided into four (4) separate and distinct phases as more particularly stated below:

(a) Round 1 will commence on the Commencement Date through 26th April, 2019, 11.59pm (“Usage Period- Round 1”);

(b) Round 2 will commence on 5th May, 2019, 12 am through 31st May, 11.59pm (“Usage Period – Round 2”);

(c) Round 3 will commence on 2nd June, 2019, 12am through 28th June, 2019, 11.59pm (“Usage Period – Round 3”); and

(d) Round 4 will commence on 1st July, 2019, 12am through 26th July, 2019, 11.59pm (“Usage Period – Round 4”).

For the purpose of these Contest Terms, Rounds 1 until 4 of these Clause 4.2 shall be collectively referred to as the “Usage Period Contest Rounds”.

4.3 The Critical Analysis Phase will commence on 21st May 2019, 12am and end on 2nd August, 2019, 11.59pm and is divided into three (3) separate and distinct phases as more particularly stated below:

(a) Round 1 will commence on 21st May, 2019, 12 am through 31st May, 2019, 11.59pm (“Critical Analysis – Round 1”);

(b) Round 2 will commence on 26th June, 2019, 12 am through 6th July, 2019, 11.59pm (“Critical Analysis – Round 2”); and

(c) Round 3 will commence on 23rd July, 2019, 12 am through 2nd August, 2019, 11.59pm(“Critical Analysis – Round 3”).

For the purpose of these Contest Terms, Rounds 1 until 3 of this Clause 4.3 shall be collectively referred to as the “Critical Analysis Contest Rounds”).

4.4 The Question and Answer Phase will commence on 20th June 2019 and end on 30th August 2019 and is divided into three (3) separate and distinct phases as more particularly stated below:

(a) In respect of Critical Analysis – Round 1, the Q&A session will be between 20th June, 2019 until 28th June, 2019 (“Q&A – Round 1”);

(b) In respect of Critical Analysis – Round 2, the Q&A session will be between 25th July, 2019 until 2nd August, 2019 (“Q&A – Round 2”); and

(c) In respect of Critical Analysis – Round 3, the Q&A session will be between 22th August, 2019 until 30th August, 2019 (“Q&A –Round 3”).

For the purpose of these Contest Terms, Rounds 1 until 3 of this Clause 4.4 shall be collectively referred to as the “Q&A Contest Rounds”).

 

5. Contest Entry Procedure

All Participants will be automatically registered into the Contest. The Participants may opt out of the Contest by completing the relevant fields in the opt-out form available on www.frogchampionships.com/opt-out within the Contest page. For further information on the opt-out process, please refer to the FAQ https://www.frogchampionships.com/faq-eng.

 

6. Contest Mechanism

6.1 The Contest Mechanism is as follows:

6.1.1 Participating Students

6.1.1.1 All Participating Students are required to log into the Frog VLE Platform and answer as many quizzes on the subjects related to the respective Usage Period Contest Rounds as more particularly stated below:-

(a) Usage Period - Round 1

Participating Students are required to answer quizzes on History, Geography, Bahasa Malaysia and English subjects and use Boost Sites;

(b) Usage Period - Round 2

Participating Students are required to answer quizzes on Science, Mathematics, Information and Communications Technology and Design and Technology subjects and use Boost Sites;

(c) Usage Period - Round 3

Participating Students are required to answer quizzes on Pendidikan Moral, Pendidikan Islam, Bahasa Cina and Bahasa Tamil subjects and use Boost Sites; and

(d) Usage Period – Round 4

Participating Students are required to answer quizzes on Science, Mathematics, Bahasa Malaysia and English subject

6.1.1.2 Participating Students may answer the quizzes at any time of the day however for the purpose of this Contest, score will only be granted to Participating Students having answered the quizzes on the Frog VLE Platform, including the Boost Site, between 7am until 10pm during the respective Usage Period Contest Rounds.

6.1.1.3 Each Participating Student’s score is determined based on the algorithm within the Frog VLE Platform in accordance to the following broad criteria:

(a) In relation to Usage Period Rounds 1 until 3:

(i) Days spent on Frog VLE Platform: Number of days spent by the Participating Students on the Frog VLE Platform to complete the quizzes.

(ii) Number of quizzes: Number of different quizzes completed by Participating Students.

(iii) Download per Boost Site: Number of unique Boost Site downloaded from the Frog VLE Platform by Participating Students.

(b) In relation to Usage Period – Round 4

(i) Days spent on Frog VLE Platform: Number of days spent by the Participating Students on the Frog VLE Platform to complete the quizzes.

(ii) Number of quizzes: Number of different quizzes completed by Participating Students.

(iii) Number of revision pack questions: Number of revision pack quizzes questions completed by Participating Students.

6.1.1.4 The score obtained by the respective Participating Students will be reflected on the students leaderboard found on Frog VLE Platform (“Student Leaderboard”) on a delayed time basis and will be refreshed daily.

6.1.1.5 A detailed description on winners’ selection process is as more particularly stated in Clause 7 of these Contest Terms.

6.1.1.6 The selection of District, State and National Level Winners–Students Category is based on the score obtained by the respective Participating Students during each Usage Period Contest Round. Participation by the Participating Students during each Usage Period Contest Round is deemed as a new participation and score will be re-set to zero on the commencement date of each Usage Period Contest Rounds

6.1.1.7 In the event any of a tie in score during the selection of District, State and National Level Winners-Students Category, the selection of tie-breaker winner will be based on the most creative answer provided by such Participating Students, as determined by FrogAsia at its sole and absolute discretion.

6.1.1.8 In the event any of the Participating Student is transferred or shifts to a new school (“New School”), any scores obtained by such Participating Student through his/her participation in the Contest prior to the official joining date in the New School will be automatically forfeited. Notwithstanding hereinbefore, the former Participating School will be entitled to retain the collective scores obtained by it through the participation of such Participant Student up to the date his/her official joining date in the New School. Such Participating Student may participate in the Contest as a participant of the New School on condition that the New School is equipped with 4G connectivity and have access to Frog VLE Platform. If the New School is an Appliance School, the Participating Student will be entitled to participate in the Contest as a participant of the New School and be subjected to the Frog Championships Boost Your Play (Frog Appliance League) Contest Terms and Conditions found @ www.frogchampionships.com/terms-conditions-appliance.

6.1.1.9 For clarity, Participating Students within the primary and secondary schools will be contesting against each other.

6.1.2 Participating Schools

(A) Usage Period Contest Round

6.1.2.1 During the Usage Period Contest Rounds, Participating School shall encourage use of the Frog VLE Platform by the Participating Student in accordance with this Contest Mechanism. In this respect, the effort of the teachers, as more particularly stated in Clause 6.1.2.2 (a)(iv)-(vi) and (b) (iv)-(vi) will contribute to the score granted to the Participating Schools.

6.1.2.2 Each Participating School’s score is determined based on the algorithm within the Frog VLE Platform in accordance to the following broad criteria:

(a) In relation to Usage Period –Rounds 1-3

(i) Days spent on Frog VLE Platform: Number of days spent by the Participating Students on the Frog VLE Platform to complete the quizzes.

(ii) Number of quizzes: Number of different quizzes completed by the Participating Students.

(iii) Download per Boost Site: Number of unique Boost Site downloaded from the Frog VLE Platform by Participating Students.

(iv) Days spent on Frog VLE Platform: Number of days spent on Frog VLE Platform by the teachers to teach the quizzes related to the subjects contested during the respective Usage Period Contest Rounds to the Participating Students.

(v) Quizzes Created: Number of original quizzes created by teachers and published for use amongst the users of the Frog VLE Platform.

(vi) Download per Boost Site: Number of unique Boost Site downloaded by teachers from Frog VLE Platform.

(b) In relation to Usage Period – Round 4

(i) Days spent on Frog VLE Platform: Number of days spent by the Participating Students on the Frog VLE Platform to complete the quizzes.

(ii) Number of quizzes: Number of different quizzes completed by Participating Students.

(iii) Number of revision pack questions: Number of revision pack quiz questions downloaded from Frog VLE Platform by the Participating Students.

(iv) Days spent on Frog VLE Platform: Number of days spent on Frog VLE Platform by the teachers to teach the quizzes related to the subjects contested during the respective Usage Period Contest Rounds to the Participating Students.

(v) Quizzes Created: Number of original quizzes created by teachers and published for use amongst the users of the Frog VLE

6.1.2.3 The score obtained by the respective Participating Schools will be reflected on the school’s leaderboard found on the Frog VLE Platform (“School Leaderboard”) on a delayed time basis and will be refreshed daily.

6.1.2.4 The selection of the District and State Level Winners-School Category will be based on the total score obtained by the Participating Schools as reflected on the School Leaderboard during each Usage Period Contest Round. Participation by the Participating Schools during each Usage Period Contest Round is deemed as new participation wherein the score will be re-set to zero on the commencement date of each Usage Period Contest Round.

6.1.2.5 In the event of a tie in score during the selection of District and State Level Winners-Schools Category, the selection of a tie-breaker winner will be based on the most creative answer provided by such Participating Schools, as determined by FrogAsia at its sole and absolute discretion.

6.1.2.6 In the event any of the teachers of the Participating School is transferred or shifts to a new school (“New School”), any score contributed through the effort of the teacher prior to the official joining date in the New School shall be automatically forfeited. Notwithstanding hereinbefore, the former Participating School shall be entitled to retain the collective scores obtained by it through the participation of such teacher up to the date his/her official joining date in the New School.

(B) Critical Analysis Contest Round

6.1.2.1 Except for Usage Period-Round 4 wherein there shall be no shortlisting of participants to participate in the Critical Analysis Contest Round, at the end of each Usage Period Contest Round, ten (10) Participating Schools with the highest overall score obtained during the respective Usage Period Contest Round, as reflected on the School Leaderboard, will be shortlisted to participate in the Critical Analysis Contest Round respectively (“Shortlisted Schools”).

6.1.2.2 These Shortlisted Schools are required to prepare and submit a critical analysis on their learning experience, with examples, on their use of Frog VLE Platform during the Contest Period on or by the respective duration stipulated in Clause 4.3 herein.

6.1.2.3 The Critical Analysis shall be prepared by using a Google Form (or such other method as notified by FrogAsia to the Shortlisted Schools, details of which are as more particularly stated below:

(a) The impact of Frog VLE Platform on students’ performance, including any changes of behaviour or habit from an academic perspective;

(b) The roles and responsibilities undertaken by the headmaster and teachers to continuously encourage students;

(c) Creative methods adopted in ensuring a school-wide use of Frog VLE Platform; and

(d) The impact of Frog VLE Platform within the scope of teaching and learning. Clauses B (6.1.2.3) (a)-(d) herein shall be collectively referred to as the “Critical Analysis”).

6.1.2.4 Each Shortlisted Schools’ score will be determined based on the qualitative and quantitative aspects incorporated into the Critical Analysis, details of which are as more particularly stated below:

(a) Quantitative Aspects

The Quantitative Aspects are as more particularly stated in Clause (A) 6.1.2.2 of these Contest Terms.

(b) Qualitative Aspects

(i) Teaching & Learning Impact: Demonstrate positive learning impact in students mindset, interest and academic progress. The respective Participating School is able to demonstrate positive impact in their teaching method, through the use of Frog VLE Platform, which resulted in easier and focused teaching and learning experience amongst teachers and students within the Participating School.

(ii) School Management & Administration Impact: The ability of the respective Participating School to produce effective and efficient outcomes in cost saving management and administration in school by their use of the Frog VLE Platform.

(iii) Evidence School Collaboration: Demonstrates the ability to collaborate between different individuals to meet school goals and the ability to overcome the challenges within a 21st century teaching and learning environment.

(C) Question & Answer Phase

6.1.2.5 After the end of the respective Critical Analysis Contest Rounds, FrogAsia will review the respective Critical Analysis and shortlist five (5) finalists from the pool of Shortlisted Schools with the most critical and creative submission, as determined by FrogAsia at its sole and absolute discretion, to participate in the respective Q&A Contest Rounds. During these Q&A Contest Rounds, the Finalists are required to address the impact of Frog VLE Platform within the scope of their teaching and learning experience before a panel of judges appointed by FrogAsia (“Finalists”). The respective Q&A Contest Rounds dates are as more particularly stated in Clause 4.3 herein.

6.1.2.6 Three (3) schools from the pool of Finalists with the most critical response provided during the respective Q&A Contest Rounds will be ranked and declared as the Grand Prize Winner, 1st and 2nd Runners-up and the balance seven (7) Shortlisted Schools will be categorised as Consolation Prize Winners.

6.1.2.7 For clarity, Participating Schools from both primary and secondary schools will be contesting against each other.

 

7. Winners Selection Process

7.1 Winners will be categorised as follows:

(a) District Level Winners-Students and Schools Category respectively;

(b) State Level Winners-Students and Schools Category respectively; and

(c) National Level Winners-Students and Schools Category respectively.

7.2 Reference to the word “district” in Clause 7.1 may not be reflective of the official district boundary determined by the relevant authorities in Malaysia. For the purpose of this Contest, the boundaries of each district are determined according to the information provided to FrogAsia by the Malaysian Ministry of Education.

7.3 At the end of each Usage Period Contest Round, subject to Clause 8.1 of these Contest Terms:

7.3.1 Three (3) Participating Students from Participating Schools respectively:

(a) with the highest score at each district will be declared as the District Level Winners (“District Level Winners-Students Category”); and

(b) with the highest score at each state will be declared as the State Level Winners (“State Level Winners- Students Category”).

For clarity, since there are 16 states in Malaysia, a total of 48 students from Participating Schools will be declared as State Level Winners-Students Category.

7.3.2 Subject to Clause 8.2 (b), twenty (20) Participating Students with the highest score will be declared as National Winners (“National Level Winners-Students Category”).

7.3.3 At the end of the Usage Period Contest Round, three (3) Participating Schools respectively with the highest score in each:

(a) district will be declared as the District Level Winners (“District Level Winners-Students Category”); and

(b) state will be declared as the State Level Winners (“State Level Winners- Students Category”).

7.3.4 Subject to Clause 8.2 (a), twenty Finalist with the highest score will be declared as the National Level Winners- School Category

For clarity, since there are 16 states in Malaysia, a total of 48 Participating Schools will be declared as State Level Winners-School Category.

 

8. Contest Prizes

8.1 Except for the National Level Winners in all the two (2) categories which are Students and School Category, the winners, in order of rank from the most to the least critical shall be categorised as:

8.1.1 Grand Prize winner

8.1.1 1st Runner Up winner

8.1.1 2nd Runner Up winner

shall be entitled to the Contest Prizes

8.2 The National Level Winners for:

(a) School Category, in order of rank from the most to the least critical shall be categorised as:

8.2.1 One (1) Grand Prize winner;

8.2.2 One (1) 1st Runner Up;

8.2.3 One (1) 2nd Runner Up; and

8.2.4 Seven (7) Consolation Prize Winners

shall be entitled to the Contest Prizes

(b) Student Category, in order of rank from the most to the least critical shall be categorised as:

8.2.1 One (1) Grand Prize winner;

8.2.2 One (1) 1st Runner Up;

8.2.3 One (1) 2nd Runner Up

8.2.4 Seventeen (17) Consolation Prize Winners

shall be entitled to the Contest Prizes

8.3 The Grand Prize Winner, 1st Runner Up and 2nd Runner Up at the:

8.3.1 District Level Winners – Students Category;

8.3.2 District Level Winners – School Category;

8.3.3 State Level Winners – Students Category;

8.3.4 State Level Winners – School Category;

will receive a certificate

8.4 The National Level Winners – Students Category will receive the following prize:

8.4.1 Grand Prize Winner will receive a Pelangi book prize worth Ringgit Malaysia Eight Hundred (RM 800) only and a championship certificate;

8.4.2 1st Runner Up will receive a Pelangi book prize worth Ringgit Malaysia Five Hundred (RM 500) only and a championship certificate;

8.4.3 2nd Runner Up will receive a Pelangi book prize worth Ringgit Malaysia Three Hundred (RM 300) only and a championship certificate;

8.4.4 Consolation Prize Winners will each receive Pelangi book prize worth Ringgit Malaysia One Hundred (RM 100) only and a championship certificate.

8.5 The National Level Winners – School Category will receive the following prize:

8.5.1 Grand Prize Winner will receive a receive a Pelangi book prize worth Ringgit Malaysia Three Thousand (RM 3,000) only and a championship certificate;

8.5.2 1st Runner Up will receive a receive a Pelangi book prize worth Ringgit Malaysia Two Thousand (RM 2,000) only and a championship certificate;

8.5.3 2nd Runner Up will receive a receive a Pelangi book prize worth Ringgit Malaysia One Thousand (RM 1,000) only and a championship certificate;

8.5.4 Consolation Prize Winners will each a receive Pelangi book prize worth Ringgit Malaysia Five Hundred (RM 500) only and a championship certificate.

(Clauses 8.3-8.5 shall be collectively referred to as the “Contest Prizes”).

8.6 The winners shall not be entitled to redeem the Contest Prizes in any other form or manner other than that specified by FrogAsia.

8.7 All Prizes are accepted entirely at the risk of the winners. Prizes are awarded by FrogAsia and/or sponsors without any warranty of any kind express or implied.

 

9. Announcement of Winners

The respective announcement will be done through  championships@frogasia.com and FrogAsia’s Facebook page and/or such other mode or manner as decided by FrogAsia at its sole and absolute discretion.

 

10. Exclusions

The Contest Prizes are given and accepted entirely at the risk of the winners. Any and all prize-related expenses, including tax liabilities (if any) in relation to this Contest, prize and/or use or enjoyment of the same, shall be the sole responsibility of the winners. FrogAsia shall not be held liable for (i) any delay in performing or partial/total failure to perform any of its obligations to the winners under this Contest if such delay or failure is caused by circumstances beyond the reasonable control of FrogAsia, its affiliates, authorized dealers/distributors, agents or suppliers, including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes or (ii) from any loss, damage to property, injury, or death resulting from or related to the Participants’ participation or inability to participate in this Contest, or the use, misuse or inability to use the Content Prizes or any portion thereof.

 

11. Unconditional Agreement

Acceptance of the Contest Prizes constitutes the winners unconditional agreement and permission to FrogAsia and its agencies to use  the winners’ names, video footages, voices, photographs and/or likeness for purposes of advertising, editorial, promotional, marketing, trade and/or other purposes without further compensation and notice, unless prohibited by law. FrogAsia reserves the right to such forms of publicity and publication.

 

12. Laws

This Contest shall in all respects be governed by the laws of Malaysia.  By entering this Contest, the Participants agree to submit to the jurisdiction of the courts of Malaysia.

 

13. Modifications

FrogAsia reserves the right to add, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Contest, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Participants or any other party. Without prejudice to the aforesaid, FrogAsia reserves the right to cancel, terminate or suspend this Contest at any time before or during the Contest Period with due notice but without any liability or compensation whatsoever. In the event of such cancellation, termination or suspension of this Contest, FrogAsia may at its sole and absolute discretion choose not to award the Prizes in respect of this Contest or choose not to select any champion.

 

14. Disruption of Contest

Without prejudice to Clause 13 above, if for any reason this Contest is not capable of running as planned or is disrupted for reasons due to and including without limitation network failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of FrogAsia or any party responsible for the running of any aspect of this Contest which corrupts or affects the administration or proper conduct of this Contest, FrogAsia reserves all rights in Clause 13 above and further reserves the right at its sole and absolute discretion to disqualify any individual or party who tampers or cheat with the processes of this Contest and/or its mechanics and FrogAsia may take any action (including legal action) against such individual or party. FrogAsia shall not accept any responsibility for entries not received for whatever reason. FrogAsia shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to this Contest.

 

15. Disclosure Rights

By entering this Contest, the Participants hereby grant to FrogAsia express permission as well as a non-exclusive, royalty-free, worldwide license to publish, print, reproduce, disseminate or share their respective entry, likeness and identity (excluding any sensitive personal information as defined by the Personal Data Protection Act 2010) for editorial, advertising, promotional, marketing or other purposes, without further compensation, for an unlimited period of time, in any of FrogAsia's publications, in any form or any media, whether for public consumption or otherwise, unless prohibited by law.

 

16. Disqualification and/or Rejection of Entries

FrogAsia reserves the right to disqualify any or all  the Participants or winners  at its sole and absolute discretion on grounds of non-compliance with any of the Contest Terms. For the avoidance of doubt, the foregoing is not meant to limit or curtail the rights of FrogAsia, who may also reject an entry without having to assign any reasons whatsoever. The Participants accept that a decision to disqualify and/or reject such International Representatives, Finalists or winners shall be final and conclusive without any right to appeal. In the event of disqualification after the Contest Prizes, FrogAsia reserves the right to demand for the return of the Contest Prize or payment of its value from such ineligible or disqualified winners.

 

17. Judging Criteria and Judging Process

FrogAsia reserves the sole and absolute discretion to determine the Finalists and winners of this Contest. The judges' decision shall be final and conclusive and no appeals or disputes will be entertained. Subject to FrogAsia's rights to replace any of the winners as provided herein, results once announced shall be deemed as final and binding.

 

18. General Indemnification

Participants shall indemnify FrogAsia against all and any demands, claims, costs, expenses, damages, liability or injury (whether physical in nature or against the reputation of any party) incurred by FrogAsia, arising out of or relating to the Participants’ participation in this Contest and/or Participants’   acceptance, use or misuse of prizes, including but not limited to any of the Participants’  acts, omissions, statements, publications whatsoever as may be in breach of any law or legal rights, as the case may be.

 

19. Third Party's Rights and Indemnification

By participating in this Contest, the Participants warrant that all personal details, answers, responses and/or entries submitted in this Contest are true and accurate. Participants agree to indemnify and keep indemnified FrogAsia against all claims, losses, damages and/or expenses whatsoever arising from any infringement or violation of any third party's rights in relation to the participation in this Contest.

 

20. Survivability of Terms

Any delay, waiver, non-enforcement, modification, amendment, withdrawal or substitution of any term or condition contained herein shall not affect the operation of the other terms or conditions so affected by such a waiver, non-enforcement, modification, amendment, withdrawal or substitution and which shall remain in full force and effect.

 

21. Personal Data

By participating in the Contest, each Participant agrees and consents to the processing of Personal Data provided to FrogAsia and/or its service providers shall be used for the purpose of the Contest and as set forth in this Contest Terms. For the avoidance of doubt, the word “Personal Data” and “processing” as used in this Clause 21 shall have the same meaning ascribed to in the Malaysian Personal Data Protection Act 2010.

 

22. Non-Compliance

Failure to comply with these Contest Terms shall result in disqualification of the relevant Participants.
