1. The Contest

The Frog Championships: Level Up (Appliance  League) Contest ("Contest") is an online contest organised by FrogAsia Sdn Bhd (Company No. 968641-K)("FrogAsia"). All eligible students, teachers and schools may participate in the Contest through the Frog VLE Platform (as defined below) and shall be governed by these Frog Championships: Level Up (Appliance League) Contest Terms and Conditions (hereinafter referred to as the “Contest Terms”). The Contest objective is aimed to test the knowledge of Participating Students in the field of Mathematics, English and Science. Simultaneously, the Contest is also aimed to encourage the Participants to use the Frog VLE Platform as part of their teaching and learning experience.

There shall be no fees or charges imposed to enter or win the Contest.

 

2. Eligibility

2.1 The Contest is organised on FrogAsia’s Frog Virtual Learning Environment or more commonly known as “Frog VLE” (“Frog VLE Platform”).

2.2     This Contest is open to:

      2.2.1  the national schools in Malaysia (“Participating Schools”);

      2.2.2  individual teachers from  national schools (“Participating Teachers”); and

      2.2.3  individual students from national schools (“Participating Students”)

      having access to the Frog VLE Platform through Frog Appliance.

For the purposes of these Contest Terms, Participating Schools, Participating Teachers and Participating Students may collectively be referred to as “Participants”.

 

3. Contest Terms Acceptance

The Participants may access the Contest page either through Frog VLE Platform or www.frogchampionships.com. Each Participant is required to click the quick launch tab for first time access to the Contest page and a welcome note will pop-up incorporating a link to the Contest Terms. Subject to a Participating Student who is a minor, each Participant confirms having read and understood, and agrees to be bound by, these Contest Terms through the Participant’s participation in the Contest. In the case of a Participant who is a minor, it is the responsibility of such minor Participants’ parents or legal guardian to continuously supervise his/her participation in the Contest.

For clarity and avoidance of doubt, each Participating School shall be entitled to a single entry participation only.  As such, in the event of multiple submissions by any of the Participating Schools, all such submissions shall be consolidated as single entry participation.

 

4. Contest Period

4.1 This Contest shall commence on 6th August, 2018, 12 am (“Commencement Date”) and end on 30 November, 11.59pm (“Contest Period”) and is divided into two (2) Main Phases namely:

       4.1.1 Frog VLE Platform Usage Phase; and

       4.1.2  Frog VLE Platform User Experience Phase.

4.2   The Frog VLE Platform Usage Phase shall commence on the Commencement Date and end on 28th October, 2018 at 11.59pm (“FrogVLE Usage Period”) and is divided into three (3) separate and distinct phases as more particularly stated below:

(a)  Contest 1st phase will commence on the Commencement Date through 2nd September 2018, 11.59pm (“Mathematics Contest Phase”);

(b)  Contest 2nd phase will commence on  3rd September, 2018, 12am through 30th September 2018, 11.59pm (“English Contest Phase”); and

(c)   Contest 3rd phase will commence on 1st October, 2018, 12am through 28th October, 2018, 11.59pm (“Science Contest Phase”).

For the purpose of these Contest Terms, Mathematics Contest Phase, English Contest Phase and Science Contest Phase shall be collectively referred to as the “Contest Phases”.

4.3 The Frog VLE User Experience Phase shall commence on 6 August, 2018 at 12am and end on 31st November, 2018 at 11.59pm. The Frog VLE User Experience Phase is limited to the Participating Teachers and Participating Schools only and is subjected to the selection process as more particularly stated in Clauses 7.4 and 7.5 respectively.

 

5. Contest Entry Procedure

All Participants shall be automatically registered to the Contest. The Participants may opt out of the Contest by completing the relevant fields in the opt-out form available on www.frogchampionships.com/opt-out within the Contest page.  For further information on the opt-out process, please refer to the FAQ here.

 

6. Contest Mechanism

6.1 The Contest Mechanism is as follows:

6.2 Participating Students

6.2.1 Each Participating Student is required to log into the Frog VLE Platform and answer as many quizzes on the subject related to the Contest Phase. For eg, during the Mathematics Contest Phase, each Participating Student is required to answer quizzes in relation to Mathematics to obtain score.

6.2.2 Score will be granted based on the algorithm within the Frog VLE Platform in accordance to the following broad criteria:

  1. Days utilised on Frog VLE Platform: Number of days spent by the Participating Student on Frog VLE Platform to  complete quizzes on the subject related to the respective Contest Phase.
  2. No of quizzes: Number of quizzes completed on the subject related to the Contest Phase.
  3. Overall improvement:  This is determined by averaging the total score allocated against the actual total scores obtained by such  Participating Students in attempting the quizzes during the respective Contest Phase.

6.2.3 The score obtained by the respective Participating Students will be reflected on the students leaderboard found on the Frog VLE Platform (“Student Leaderboard”) on a delayed time basis and will be refreshed every day during the Frog VLE Usage Period by 9am.

6.2.4 The selection of District Level Winners-Students Category and State Level Winners- Students Category will be based on the score obtained by each Participating Students during each Contest Phase. Therefore, participation by the Participating Students during each Contest Phase is deemed as a new participation and allocation of score will commence effective from the commencement date of each Contest Phase.

6.2.5 The selection of National Level Winners-Student Category will be based on the total score obtained by each Participating Students during the FrogVLE Usage Period i.e. selection is based on the accumulation of the total score obtained in all the Contest Phases.

6.2.6 In the event any of the Participating Student is transferred or shifts to a new school (“New School”), any scores obtained by such Participating Student through his/her participation in the Contest prior to the official joining date at the New School shall be automatically forfeited. Notwithstanding hereinbefore, the former Participating  School shall be entitled to retain the collective scores obtained by it through the participation of such Participant Students up to the date his/her official joining date at the New School. Such Participating Student may participate in the Contest as a participant of the New School on condition that the New School is equipped with 4G connectivity and have access to Frog VLE Platform. If the New School is an Appliance School, the Participating Student will be entitled to participate in the Contest as a participant of the New School and be subjected to the Frog Championships: Level Up (Appliance League) Contest Terms and Conditions at www.frogchampionships.com/terms-conditions.

6.2.7 In the event of a tie in score during the selection of:-

(a) District and State Level Winners-Students Category, at the end of any of the Contest Phase, the selection of tie-breaker winner will be determined based on average performance increase by using the following formula; 

The difference between the average score obtained on the last day of participation against the 1st day of participation during such Contest Phase.

(b) National Level Winners – Students Category, at the end of the FrogVLE Usage Period, the selection of tie-breaker winner will be determined based on average performance increase by using the following formula;

By adding the total sum achieved from the difference between the average score obtained on the last day of participation against the 1st day of participation in the Contest during all of the Contest Phases.         

6.2.8 A detailed description of winners selection process is as more particularly stated in Clause 7 of this Contest Terms.

6.2.9 For clarity, Participating Students within the primary and secondary schools will not be contesting against each other.

 

6.3 Participating Teachers

6.3.1 During each Contest Phase, Participating Teachers are required to log in to the Frog VLE Platform and copy, use and/or share all such quizzes related to the particular subject contested during such Contest Phase by creating availability and provide exposure on quizzes, including the Community Quizzes, to the Participating Students as part of teaching and learning experience.

6.3.2 Score will be granted based on the algorithm within the Frog VLE Platform in accordance to the following broad criteria:

  1. No. of days: Number of days utilised by the Participating Teachers to teach the quizzes related to the subject of the respective Contest Phase to the Participating Students.
  2. Subject quizzes suggested for student learning: No. of quizzes extracted from the Community Quizzes and used as part of teaching and learning experience amongst the students in school.

6.3.3 The score obtained by the respective Participating Teachers will be reflected on the teachers leaderboard found on the Frog VLE Platform (“Teachers Leaderboard”) on a delayed time basis and will be refreshed every day during the Frog VLE Usage Period by 9am.

6.3.4 The selection of District Level Winners-Teachers Category and State Level Winners- Teachers Category will be based on the score obtained by the Participating Teachers during each Contest Phase. Therefore, participation by Participating Teachers during each Contest Phase is deemed as a new participation and allocation of score will commence effective from the commencement date of each Contest Phase.

6.3.5 The selection of National Level Winners-Teachers Category is as more particularly described in Clause 7 herein

6.3.6 In the event of a tie in score during the selection of District and State Level Winners-Teachers Category, after the end of any of the Contest Phase, such Participating Teachers are required to respond to a tie-breaker question posed by FrogAsia. The Participating Teacher with the most creative answer as determined by FrogAsia at its sole and absolute discretion will be declared as a winner of the respective Contest Phase.

6.3.7 In the event any of the Participating Teacher is transferred or shifts to a new school (“New School”), any scores obtained by such Participating Teacher through his/her participation in the Contest prior to the official joining date at the New School shall be automatically forfeited. Notwithstanding hereinbefore, the former Participating School shall be entitled to retain the collective scores obtained by it through the participation of such Participant Teacher up to the date his/her official joining date at the New School. Such Participating Teacher may participate in the Contest as a participant of the New School on condition that the New School is equipped with 4G connectivity and have access to Frog VLE Platform. If the New School is an Appliance School, the Participating Teacher  will be entitled to participate in the Contest as a participant of the New School and be subjected to the Frog Championships: Level Up (Frog Appliance School) Contest Terms and Conditions at www.frogchampionships.com/terms-conditions-appliance.

6.3.8 A detailed description of the winners selection process is more particularly stated in Clause 7 of this Contest Terms.

6.3.9 For clarity, Participating Teachers within the primary and secondary schools will not be contesting against each other.

 

6.4 Participating Schools

6.4.1 During the Frog VLE Usage Period and at each of the Contest Phase, Participating School shall encourage use of the Frog VLE Platform by the Participating Teachers and Participating Students in accordance to this Contest Mechanism.

6.4.2 The Participating School’s score is based on the accumulated total score obtained by the Participating Students and Participating Teachers of the respective Participating Schools during each Frog VLE Usage Phase.

6.4.3 The score obtained by the Participating School during each Contest Phase will be reflected on the school leaderboard found on the Frog VLE Platform (“School Leaderboard”) on a delayed time basis and will be refreshed every day during the Contest Period by 9am.

6.4.5 The selection of the District Level Winners –School Category and State Level Winners-School Category will be based on the total score reflected on the School Leaderboard during each Contest Phase.

6.4.6 The selection of National Level Winners-School Category is as more particularly stated in Clause 7 of these Contest Terms.

6.4.7  In the event of a tie in score during the selection of District and State Level Winners-Schools Category, after the end of any of the Contest Phase, such Participating Schools  are required to respond to a tie-breaker question posed by FrogAsia. The Participating School with the most creative answer as determined by FrogAsia at its sole and absolute discretion will be declared as a winner of the respective Contest Phase.

6.4.8 For clarity, Participating Schools from the primary and secondary schools will not be contesting against each other.

 

7. Winners Selection Process

7.1 The Winners will be categorised as follows:

7.1.1 District Level Winners – Students, Teachers and Schools Category respectively;

7.1.2 State Level Winners – Students, Teachers and Schools Category respectively; and

7.1.3 National Level Winners – Students, Teachers and Schools Category respectively.

7. 2 Reference to the word “district” in Clause 7.1.1 may not be reflective of the official district boundary determined by the relevant authorities in Malaysia. For the purpose of this Contest, the boundaries of each district are determined according to the information provided to FrogAsia by the Malaysian Ministry of Education.

7.3 At the end of each Contest Phase, subject to Clause 8.1 of these Contest Terms:

7.3.1 (a) three (3) Participating Students from both the primary and secondary schools respectively with the highest score:

(i) at each district  will be declared as the District Level Winners (“District Level Winners – Students Category”);

(ii) at each state will be declared as the State Level Winners (“State Level Winners- Students Category”), and

(b) Three (3) Participating Students from both primary and secondary schools respectively from each state with the highest score will be declared as the national winner (“National Level Winners-Schools Category”). For clarity,  since there are 16 states in Malaysia, a total of 96 students from both primary and secondary schools will be declared as National Level Winners- School Category.

7.3.2 Three (3) Participating Teachers and Participating Schools from both primary and secondary schools respectively with the highest score:

(a) at each district will be declared as the District Level Winners (“District Level Winners – Teachers Category”);  and

(b) at each state will be declared as the State Level Winner (“State Level Winners- Teachers Category”).

7.3.3 Three (3) Participating Schools from both primary and secondary schools respectively with the highest score:

(a) at each district will be declared as the District Level Winners (“District Level Winners – School Category”);  and

(b) at each state will be declared as the State Level Winner (“State Level Winners – School Category")

7.4 At the end of the FrogVLE Usage Period:-

7.4.1 Twenty (20) Participating Teachers from primary and secondary schools respectively, from the sixteen (16) States, with the highest overall accumulated score obtained during the Frog VLE Usage Period will be selected as finalists (“Shortlisted-Teachers Category”). These Shortlisted -Teachers Category shall prepare a submission on their teaching and learning experience using the Frog VLE Platform according to the format and criteria prescribed by FrogAsia (“Submission”). The Submission shall be submitted to FrogAsia @ championships@frogasia.com on or by  the submission date deadline provided in the official email communications sent by championships@frogasia.com.

7.4.2 FrogAsia will review each of the Submission and shortlist five (5) finalists from the pool of Shortlists-Teachers Category (“Finalists”). These Finalists will be required to attend to an interview and question and answer session with FrogAsia on the impact of the Frog VLE Platform on their teaching and learning experience before a panel of judges appointed by Frog Asia on a pre-arranged date/(s).

7.4.3 Six (6) Participating Teachers, three (3) each from primary and secondary schools respectively, from the pool of Finalists, with the most critical analysis and response will be ranked and declared as National Winners – Teachers Category and the balance seventeen (17) Shortlisted-Teachers Category from primary and secondary schools respectively will be declared as the Consolation Prize Winners-Teachers Category.

7.5 At the end of the FrogVLE Usage Period:-

7.5.1 Twenty (20) Participating Schools from primary and secondary schools respectively, from the sixteen (16) States, with the highest overall accumulated score obtained during the Contest Period will be selected as finalists (“Shortlisted-School Category”). These Finalists-School Category shall prepare and submit the Submission to FrogAsia on by or on the submission date deadline provided in the official email communications sent by championships@frogasia.com.

7.5.2 FrogAsia will review each of the Submission and shortlist five (5) finalist from the pool of Shortlisted-School Category to attend to an interview and question and answer session with FrogAsia on the impact of the Frog VLE Platform within the scope of teaching and learning before a panel of judges appointed by FrogAsia on pre-arranged date/(s)(“Finalists-School Category”).

7.5.3 Six (6) participating schools, three (3) each from primary and secondary schools respectively, from the pool of Finalists, with the most critical analysis and response will be ranked and declared as National Winners – Schools Category and the seventeen (17) other Shortlisted-Schools Category from primary and secondary schools respectively will be declared as the Consolation Prize Winners-Schools Category.

 

8. Contest Prizes

8.1 Except for the National Level Winners in all the three (3) categories which are Students, Teachers and School Category, the winners, in order of rank from the most to the least critical shall be categorised as:

8.1.1   Grand Prize winner;

8.1.2   1st Runner Up; and

8.1.3   2nd Runner Up

          and shall be entitled to the Contest Prizes

8.2 The National Level Winners in Teachers and School Category, in order of rank from the most to the least critical shall be categorised as:

8.2.1 Seventeen (17) Consolation Prize Winners.

8.2.2 One (1) 2nd Runner Up; and

8.2.3 One (1) 1st Runner Up;

8.2.4 One (1) Grand Prize winner;

8.2A The National Level Winners – Students Category,in order of rank from the most to the least critical shall be categorised as:

8.2.1 One (1) Grand Prize winner;

8.2.2 One (1) 1st Runner Up;

8.2.3 One (1) 2nd Runner Up; and

8.2.4 forty five (45) Consolation Prize Winners.

from both primary and secondary schools respectively.

8.3 The Grand Prize Winner, 1st Runner Up and 2nd Runner Up at the:

8.3.1 State Level Winners – School Category

8.3.2 State Level Winners – Teachers Category; and

8.3.3 State Level Winners – Students Category;

8.3.4 District Level Winners – School Category;

8.3.5 District Level Winners – Teachers Category;

8.3.6 District Level Winners – Students Category;

will each receive a championship certificate.

8.4 The National Level Winners – Students Category will receive the following prize:

8.4.1 Grand Prize Winner will receive a book prize worth Ringgit Malaysia Five Hundred (RM 500) only and a championship certificate;

8.4.2 1st Runner Up will receive a book prize worth Ringgit Malaysia Three Hundred (RM 300) only and a championship certificate;

8.4.3 2nd Runner Up will receive a book prize worth Ringgit Malaysia Two Hundred (RM 200) only and a championship certificate; and

8.4.4 Consolation Prize Winners will each receive Frog button badges worth (RM 18) and a championship certificate.

8.5 The National Level Winners – Teachers Category will receive the following prize:

8.5.1 Grand Prize Winner will receive a book prize worth Ringgit Malaysia Eight Hundred (RM 800) only and a championship certificate;

8.5.2 1st Runner Up will receive a book prize worth Ringgit Malaysia Five Hundred (RM 500) only and a championship certificate;

8.5.3 2nd Runner Up will receive a book prize worth Ringgit Malaysia Three Hundred (RM 300) only and a championship certificate; and

8.5.4  Consolation Prize Winners will each receive one (1) unit of Frog water bottle worth (RM 18) and a  championship certificate.

8.6 The National Level Winners- School Category will receive the following prize:

8.6.1 Grand Prize Winner will receive a book prize worth Ringgit Malaysia Three Thousand (RM 3,000) only and a championship certificate;

8.6.2 1st Runner Up will receive a book prize worth Ringgit Malaysia Two Thousand (RM 2,000) only and a championship certificate;

8.6.3 2nd Runner Up will receive a book prize worth Ringgit Malaysia One Thousand (RM 1,000) only and a championship certificate; and

8.6.4 Consolation Prize Winners will each receive Frog button badges worth (RM 200) and a championship certificate.

(Clauses 8.3-8.6 shall be collectively referred to as the “Contest Prizes”).

8.7 The winners shall not be entitled to redeem the Contest Prizes in any other form or manner other than that specified by FrogAsia.

8.8 All Prizes are accepted entirely at the risk of the winners. Prizes are awarded by FrogAsia and/or sponsors without any warranty of any kind express or implied.

 

9. Announcement of Winners

The respective announcement will be done through  championships@frogasia.com and FrogAsia’s Facebook page and/or such other mode or manner as decided by FrogAsia at its sole and absolute discretion.

 

10. Exclusions

The Contest Prizes are given and accepted entirely at the risk of the winners. Any and all prize-related expenses, including tax liabilities (if any) in relation to this Contest, prize and/or use or enjoyment of the same, shall be the sole responsibility of the winners. FrogAsia shall not be held liable for (i) any delay in performing or partial/total failure to perform any of its obligations to the winners under this Contest if such delay or failure is caused by circumstances beyond the reasonable control of FrogAsia, its affiliates, authorized dealers/distributors, agents or suppliers, including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes or (ii) from any loss, damage to property, injury, or death resulting from or related to the Participants’ participation or inability to participate in this Contest, or the use, misuse or inability to use the Content Prizes or any portion thereof.

 

11. Unconditional Agreement

Acceptance of the Contest Prizes constitutes the winners unconditional agreement and permission to FrogAsia and its agencies to use  the winners’ names, video footages, voices, photographs and/or likeness for purposes of advertising, editorial, promotional, marketing, trade and/or other purposes without further compensation and notice, unless prohibited by law. FrogAsia reserves the right to such forms of publicity and publication.

 

12. Laws

This Contest shall in all respects be governed by the laws of Malaysia.  By entering this Contest, the Participants agree to submit to the jurisdiction of the courts of Malaysia.

 

13. Modifications

FrogAsia reserves the right to add, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Contest, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Participants or any other party. Without prejudice to the aforesaid, FrogAsia reserves the right to cancel, terminate or suspend this Contest at any time before or during the Contest Period with due notice but without any liability or compensation whatsoever. In the event of such cancellation, termination or suspension of this Contest, FrogAsia may at its sole and absolute discretion choose not to award the Prizes in respect of this Contest or choose not to select any champion.

 

14. Disruption of Contest

Without prejudice to Clause 13 above, if for any reason this Contest is not capable of running as planned or is disrupted for reasons due to and including without limitation network failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of FrogAsia or any party responsible for the running of any aspect of this Contest which corrupts or affects the administration or proper conduct of this Contest, FrogAsia reserves all rights in Clause 13 above and further reserves the right at its sole and absolute discretion to disqualify any individual or party who tampers or cheat with the processes of this Contest and/or its mechanics and FrogAsia may take any action (including legal action) against such individual or party. FrogAsia shall not accept any responsibility for entries not received for whatever reason. FrogAsia shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to this Contest.

 

15. Disclosure Rights

By entering this Contest, the Participants hereby grant to FrogAsia express permission as well as a non-exclusive, royalty-free, worldwide license to publish, print, reproduce, disseminate or share their respective entry, likeness and identity (excluding any sensitive personal information as defined by the Personal Data Protection Act 2010) for editorial, advertising, promotional, marketing or other purposes, without further compensation, for an unlimited period of time, in any of FrogAsia's publications, in any form or any media, whether for public consumption or otherwise, unless prohibited by law.

 

16. Disqualification and/or Rejection of Entries

FrogAsia reserves the right to disqualify any or all  the Participants or winners at its sole and absolute discretion on grounds of non-compliance with any of the Contest Terms. For the avoidance of doubt, the foregoing is not meant to limit or curtail the rights of FrogAsia, who may also reject an entry without having to assign any reasons whatsoever. The Participants accept that a decision to disqualify and/or reject such International Representatives, Finalists or winners shall be final and conclusive without any right to appeal. In the event of disqualification after the Contest Prizes, FrogAsia reserves the right to demand for the return of the Contest Prize or payment of its value from such ineligible or disqualified winners.

 

17. Judging Criteria and Judging Process

FrogAsia reserves the sole and absolute discretion to determine the Finalists and winners of this Contest. The judges' decision shall be final and conclusive and no appeals or disputes will be entertained. Subject to FrogAsia's rights to replace any of the winners as provided herein, results once announced shall be deemed as final and binding.

 

18. General Indemnification

Participants shall indemnify FrogAsia against all and any demands, claims, costs, expenses, damages, liability or injury (whether physical in nature or against the reputation of any party) incurred by FrogAsia, arising out of or relating to the Participants’ participation in this Contest and/or Participants’   acceptance, use or misuse of prizes, including but not limited to any of the Participants’ acts, omissions, statements, publications whatsoever as may be in breach of any law or legal rights, as the case may be.

 

19. Third Party's Rights and Indemnification

By participating in this Contest, the Participants warrant that all personal details, answers, responses and/or entries submitted in this Contest are true and accurate. Participants agree to indemnify and keep indemnified FrogAsia against all claims, losses, damages and/or expenses whatsoever arising from any infringement or violation of any third party's rights in relation to the participation in this Contest.

 

20. Survivability of Terms

Any delay, waiver, non-enforcement, modification, amendment, withdrawal or substitution of any term or condition contained herein shall not affect the operation of the other terms or conditions so affected by such a waiver, non-enforcement, modification, amendment, withdrawal or substitution and which shall remain in full force and effect.

 

21. Personal Data

By participating in the Contest, each Participant agrees and consents to the processing of Personal Data provided to FrogAsia and/or its service providers shall be used for the purpose of the Contest and as set forth in this Contest Terms. For the avoidance of doubt, the word “Personal Data” and “processing” as used in this Clause 21 shall have the same meaning ascribed to in the Malaysian Personal Data Protection Act 2010.

 

22. Non-Compliance

Failure to comply with these Contest Terms shall result in disqualification of the relevant Participants.
